Agreement to These Terms

These Terms of Service ("Terms") govern your use of Gemini Omni, including the website, image-generation features, accounts, paid plans, and related services. By accessing or using the service, you agree to these Terms.

If you use the service on behalf of a company or other entity, you represent that you have authority to bind that entity.

Eligibility and Accounts

You must be legally allowed to use the service. You are responsible for maintaining accurate account information, protecting your login credentials, and all activity that occurs under your account.

We may allow limited guest usage for certain flows. Guest access, free quotas, and paid access rules may change over time.

Your Content

You are responsible for the prompts, uploads, reference materials, and other content you submit to the service. You represent that you have the rights needed to use that content and to authorize the processing required to operate the service.

You retain ownership of your inputs. Subject to applicable law and third-party provider terms, you retain your rights in generated outputs. You grant us and our service providers a limited license to host, store, reproduce, transmit, modify as technically necessary, and display your content solely to operate, secure, improve, and support the service.

Acceptable Use

You may not use Gemini Omni to:

violate law or third-party rights;
upload or generate content you do not have permission to use;
abuse, overload, probe, reverse engineer, or interfere with the service;
bypass rate limits, usage controls, paywalls, or safety systems;
distribute malware, phishing, spam, or deceptive content;
use the service in a way that infringes privacy, publicity, copyright, trademark, or other rights.

We may remove content, throttle requests, block generations, suspend accounts, or take other action if we believe use violates these Terms or creates risk.

AI Output Notice

AI-generated results may be inaccurate, incomplete, offensive, unavailable, or similar to content generated for other users. You are responsible for reviewing outputs before using, publishing, licensing, or relying on them.

Paid Plans, Credits, and Billing

Some features require payment, a subscription, or prepaid credits. Prices, credit amounts, expiration rules, and plan benefits are shown in the product or at checkout and may change for future purchases.

Credits have no cash value, are not property, and are not transferable unless we expressly state otherwise.
Add-on credits, subscriptions, and other purchases are non-refundable except where required by law or expressly stated by us.
If a subscription renews automatically, you can cancel future renewals before the next billing cycle.
We may suspend or revoke access for chargebacks, fraud, abuse, failed payments, or material violations of these Terms.

Service Availability

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, perfect output quality, or compatibility with every use case. Features, models, quotas, and pricing may change, be delayed, or be discontinued at any time.

Intellectual Property

The service, website, software, branding, and related materials are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms do not grant you ownership of our software, trademarks, or branding.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the service.

To the extent a liability cap is permitted, our total liability for claims related to the service will not exceed the amount you paid us for the service during the 12 months before the claim arose.
